The High Court in Zimbabwe has delivered a ruling denying an expedited request from Ouro Tanque Private Limited. This company had sought immediate command of several mining sites situated in Bindura, a decision that will stand until an appeal lodged by Freda Rebecca Gold Mine Limited has been fully resolved, according to AllAfrica Top. The dispute centers on the legal rights to operate these specific gold mining areas. Ouro Tanque's application was structured as an urgent plea for interim relief, aiming to take over the sites while the primary legal challenge unfolds. However, the court determined that the circumstances did not warrant such an immediate intervention. Justice Pisirayi Kwenda, presiding over the case, concluded that the submissions made by Ouro Tanque did not fulfill the criteria for an urgent matter. The judge emphasized that the arguments presented did not establish the necessity for the court to grant possession of the contentious gold claims without further deliberation on the substantive appeal. The core of the ongoing legal battle stems from a previous decision by a provincial mining director. This official had initially canceled Freda Rebecca Gold Mine’s registration for the disputed claims, concurrently registering them in favor of Ouro Tanque. That initial administrative determination is what Freda Rebecca is now appealing. In response to the director's action, Freda Rebecca Gold Mine subsequently filed an appeal with the High Court, challenging the validity of the cancellation and the subsequent transfer of the claims. This appeal seeks to overturn the provincial mining director's ruling and reinstate Freda Rebecca's rights to the Bindura sites. Ouro Tanque’s recent urgent application was an attempt to preempt the outcome of Freda Rebecca’s appeal, aiming to secure control of the resources immediately. However, the court’s latest ruling means that the status quo will largely remain in place, with Freda Rebecca’s appeal process continuing without Ouro Tanque gaining immediate operational access to the sites. The High Court's decision underscored the judicial process's adherence to established legal procedures, prioritizing a full review of the appeal rather than granting provisional control based on an urgent application.
